These Terms of Use govern access to the performstars.com website, user account, mobile applications, and other PerformStars services (collectively, the “Service”). By using the Service, creating an account, uploading video, or purchasing access, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service and do not upload videos, personal data, or other materials to the Service.
I. Definitions and Service Status
“PerformStars,” “we,” “us,” or “our” means the owner and operator of the Service. “User” or “you” means any person who visits the website, creates an account, uploads video, receives reports or recommendations, or pays for access.
The Service provides informational and analytical services: receiving sports videos, technical processing, tagging, analysis of match or training episodes, and generation of reports, statistics, comparisons, recommendations, and training tasks. The Service is not a medical, educational, coaching, agency, scouting, legal, or financial service.
Recommendations, reports, scores, ratings, comparisons, algorithmic outputs, and any specialist comments are provided for informational purposes only. You remain solely responsible for decisions about training, competition, workload, technique, health, career, and any other actions based on information obtained through the Service.
II. Account and Eligibility
Some features may require registration. You agree to provide accurate data, keep your profile up to date, and maintain the confidentiality of your login, password, devices, and account access.
All actions performed through your account are deemed to be performed by you unless you prove unauthorized access and notify us of the security incident without undue delay.
If you act on behalf of a team, club, school, sports section, parent, athlete, or organization, you confirm that you have authority to upload materials, provide data, and accept these Terms.
The Service is not intended for independent use by children under 13. If video or data relates to a minor, you confirm that you are a parent, legal guardian, or otherwise have all necessary consents to upload, process, and use those materials in the Service.
If you are a coach, club, parent, tournament organizer, school, sports section, or other person uploading video of an athlete, you confirm that you have the required consent for recording, uploading, storing, analyzing, and displaying reports based on that video. This includes consent or another lawful basis where the video shows other players, coaches, spectators, children, staff, billiard tables, club premises, competition locations, or other identifiable people or locations.
III. Videos and User Materials
You may upload training videos, match videos, drills, game fragments, images, profile data, athlete parameters, comments, and other materials. You retain your rights to your materials, but grant PerformStars a non-exclusive license to store, copy, technically process, analyze, tag, transform, create reports from, and display them within the Service to the extent necessary to provide the Service.
You represent that you have all rights and consents required to upload videos and other materials, including consents from athletes, coaches, parents, legal guardians, clubs, venues, event organizers, or other affected persons where applicable. You must not upload materials that violate third-party rights, law, competition rules, venue rules, trade secrets, privacy, dignity, or reputation of others.
You are responsible for the quality and content of uploaded videos. Poor recording quality, wrong camera angle, poor lighting, obstruction of the player, editing, missing episodes, errors in source data, or incomplete recordings may affect the accuracy of analysis and usefulness of recommendations.
We may refuse to process, remove, hide, or restrict access to materials if they violate these Terms, law, third-party rights, technical requirements of the Service, or create a security or reputational risk for the Service.
IV. Closed Processing Environment
User-uploaded videos are analyzed within a closed processing environment of the Service. Access is limited to technical systems, authorized team members, and contractors who need access for video processing, support, quality control, security, or performance of our obligations to the user.
We do not sell user videos to third parties. We do not publish private videos as public content without user consent or another lawful basis. However, operation of the Service may require hosting, cloud infrastructure, databases, analytics, payment, email, monitoring, and other technical providers.
De-identified, aggregated, or statistical data that does not identify a specific user or athlete may be used to improve algorithms, analysis quality, new features, internal analytics, and demonstration of general Service capabilities.
V. Free Limits and Paid Access
Some features may be available free of charge within limits, including the number of videos, reports, analyses, storage volume, access period, modules, or other parameters. Specific limits may be shown in the Service interface, pricing page, user account, or support communications.
After the free limit is exhausted, further access to analysis, reports, advanced features, storage, new recommendations, or additional processing may require payment. We may change free limits, available features, pricing, and access terms unless otherwise expressly agreed with you.
Payment may be made through Apple Pay, Apple payment tools, bank cards, payment providers, direct bank transfer, or other methods available in the Service or agreed with us. The selected payment method may affect billing, confirmation, renewal, refund, and subscription management procedures.
VI. Subscription, Renewal, and Cancellation
Paid access may be provided as a one-time purchase, service package, paid period, or automatically renewing subscription. The period, price, currency, features, trial period, if any, and next billing date are shown before payment or in the subscription management interface.
If a subscription is purchased through Apple, subscription management, cancellation, plan changes, and refunds are handled under Apple rules through Apple ID, App Store, or Apple payment interfaces. Typically, a subscription renews automatically unless you cancel it at least 24 hours before the end of the current paid period; billing for the next period may also occur within 24 hours before the end of the period. The exact rules are governed by Apple terms in effect at the time of purchase.
If payment is made by direct transfer or another method outside Apple, subscription or paid access is activated after funds are actually received and the payment is identified. For such payments, we may request transfer confirmation, account email, user ID, or other data necessary to allocate the payment.
Cancellation stops future charges but does not automatically entitle you to a refund for an already paid period unless required by law, payment provider rules, or a separate written agreement. After the paid period ends, access to paid features may be restricted.
VII. Apple Auto-Renewable Subscription
The auto-renewable subscription product offered in the iOS app is called PerformStars Pro, unless a different localized name is shown in the purchase screen. PerformStars Pro provides paid access to premium Service features, which may include video analysis after the free limit, generated reports, analysis history, recommendations, advanced statistics, and other premium functionality shown in the app before purchase. The exact features available to you depend on the subscription product, app version, country, and plan displayed at checkout.
Subscription duration, price, currency, trial period, if any, and renewal date are shown in the Apple purchase screen before confirmation. The available period may be monthly, annual, or another period supported by Apple and displayed in the app for the selected subscription product.
PerformStars Pro renews automatically until canceled. Payment is charged to the Apple ID account used to confirm the purchase. Apple may charge the renewal within 24 hours before the end of the current paid period. To avoid renewal, you must cancel the subscription through your Apple ID or App Store subscription settings before the renewal deadline shown by Apple. Deleting the app or deleting your PerformStars account does not automatically cancel an Apple subscription.
You can manage or cancel the subscription in iOS by opening Settings, tapping your Apple ID, selecting Subscriptions, and choosing the PerformStars subscription. Refund requests for Apple purchases are handled by Apple under Apple rules and applicable law. We do not control Apple refund decisions.
If you reinstall the app, change devices, or lose access to premium features after an Apple purchase, you should use Restore Purchases in the app, where available, or contact support at info@performstars.com. Restore Purchases is intended to restore valid Apple entitlements for the same Apple ID, but it does not create a new subscription and does not refund previous payments.
At this time, Google Play auto-renewable subscriptions are not offered by PerformStars. Access sold outside Apple, including manual direct sales requested by email, is not automatically renewed through Google Play. Such access is activated manually after payment confirmation and is governed by the direct payment terms shown or agreed with you.
VIII. Payments and Refunds
Before confirming payment, you are responsible for verifying that the selected plan, period, scope of services, and payment method match your expectations. All prices may include or exclude taxes, bank fees, payment system fees, currency conversion, and other charges depending on the payment method and your jurisdiction.
Refunds for Apple payments are reviewed by Apple under App Store rules and applicable law. We do not control Apple refund decisions and cannot guarantee approval.
Refunds for direct transfers are reviewed individually. We may refuse a refund if the service has already been provided, access has been granted, video has been processed, a report has been generated, a limit has been used, the user has violated these Terms, or the refund is not possible under law, bank rules, or payment system rules.
In case of a technical payment error, duplicate charge, or incorrect allocation, you should contact support with payment confirmation. We will review the payment and, if the error is confirmed, provide access, credit the payment, or initiate a refund by an available method.
IX. No Guarantee of Results
The Service is provided “as is” and “as available.” We do not guarantee that the analysis will be error-free, complete, uninterrupted, suitable for your specific purpose, or that it will lead to any sports, commercial, medical, career, ranking, or other result.
We do not guarantee wins, improvement in playing level, receipt of a contract, club invitation, injury prevention, correctness of training decisions, accuracy of automatic tagging for every episode, or consistency of Service outputs with opinions of a coach, referee, doctor, agent, club, or competition organizer.
Analysis may be performed automatically, semi-automatically, or with the involvement of specialists. Results are a probabilistic technical interpretation of the submitted video, not an absolute measurement or guaranteed professional conclusion. Analysis quality may depend on camera angle, lighting, frame rate, video resolution, stability, visibility of the player, table, balls, cue, pockets, and other objects, as well as recording completeness and source data accuracy.
Any recommendations should be applied with regard to age, health, physical condition, technique, training conditions, advice of a qualified coach or medical professional, and other individual circumstances. You accept the risk of applying information obtained through the Service.
X. Limitation of Liability
To the maximum extent permitted by law, PerformStars is not liable for indirect damages, lost profits, data loss, sports injuries, incorrect user decisions, actions of coaches, clubs, payment providers, hosting providers, third parties, communication failures, Service unavailability, or consequences of using reports and recommendations.
If PerformStars liability cannot be fully excluded, it is limited to the amount actually paid by the user for the relevant service during the three months preceding the event giving rise to the claim, unless mandatory law provides otherwise.
You agree to defend and hold PerformStars harmless from third-party claims related to unlawful uploading of materials, lack of consents, infringement of copyrights, image rights, personal data rights, competition rules, or other violations of these Terms by you.
XI. Prohibited Use
You must not:
- upload illegal, offensive, discriminatory, or harmful materials;
- upload videos without necessary rights and consents;
- impersonate another person or use another person’s account;
- bypass limits, payment restrictions, security, or technical measures of the Service;
- copy, scrape, resell, or use the Service for competing products without permission;
- interfere with infrastructure, attempt unauthorized access, or extract data of other users;
- present reports as guaranteed professional opinions, medical diagnoses, or official certifications.
XII. Intellectual Property
All rights to the interface, design, software code, databases, algorithms, analysis methods, texts, images, trademarks, logos, and other elements of the Service belong to PerformStars or their respective right holders.
You receive a limited, revocable, non-transferable right to use the Service for personal, sports, training, or internal purposes in accordance with your selected plan. Any other use requires prior consent from PerformStars.
Reports and recommendations generated from user videos may be used by you for personal training, communication with a coach, athlete, parent, club, or team, provided that such use does not violate third-party rights or plan terms.
XIII. Suspension and Termination
We may temporarily restrict, suspend, or terminate your access to the Service, remove materials, or refuse processing if you violate these Terms, law, third-party rights, payment rules, technical requirements, create a security threat, or abuse free limits.
You may stop using the Service and request account deletion through available settings or support. Account deletion does not cancel already accrued payment obligations, obligations related to third-party rights, or provisions of these Terms that by their nature should survive termination.
XIV. Changes to the Service and Terms
We may update the Service, add or remove features, change pricing, free limits, technical requirements, and service procedures. Material changes apply from publication, notice in the interface, or another date specified by us.
Continued use of the Service after changes means that you accept the updated Terms. If you do not agree with the changes, you must stop using the Service and, if you have a subscription, cancel it using the available method.
XV. Privacy
The collection, storage, processing, and deletion of personal data are described in our Privacy Policy. It forms part of these Terms.
